1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Player," "you," or "your") and winzer ("winzer," "we," "us," or "our"), governing your access to and use of the winzer online gaming platform located at https://winzer.cam and any related services, features, content, or applications offered by winzer (collectively, the "Services").

By registering an account, accessing the winzer platform, placing wagers, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Responsible Gaming Policy, which are incorporated herein by reference. 2.2 Geographic Restrictions

The Services are intended primarily for users physically located in the Republic of the Philippines. Access to the Services may be restricted or prohibited in certain jurisdictions where online gambling is illegal or restricted by law. It is your sole responsibility to determine whether your use of the Services complies with applicable laws in your jurisdiction.

2.3 Capacity to Contract

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Services, including placing wagers and participating in games, you must register an account ("Account"). During registration, you will be required to provide accurate and complete information, including your full legal name, date of birth, email address, phone number, and payment information.

You may only register one (1) Account per person. Multiple accounts, duplicate accounts, or accounts registered using false information are strictly prohibited and will result in immediate termination of all accounts and forfeiture of any balances or winnings. winzer employs sophisticated detection systems to identify duplicate accounts.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your Account credentials, including your username and password. You agree to immediately notify winzer of any unauthorized use of your Account or any other breach of security. winzer shall not be liable for any loss or damage arising from your failure to protect your Account credentials.

You must not share your Account credentials with any third party. All activities conducted through your Account shall be deemed to have been authorized by you, regardless of whether such activities were actually authorized. You agree to be fully responsible for all activities that occur under your Account.

3.3 Account Verification

winzer reserves the right to verify your identity at any time through Know Your Customer (KYC) procedures. You agree to provide all requested documentation promptly, including but not limited to government-issued identification, proof of address, and proof of payment method ownership. Failure to comply with verification requests may result in account suspension and withdrawal restrictions until verification is completed.

Verification may be required before your first withdrawal, at random intervals, or whenever suspicious activity is detected. winzer may use third-party verification services to confirm your identity and age. By using the Services, you consent to such verification procedures.

4. Deposits and Withdrawals

4.1 Deposits

You may fund your Account using payment methods accepted by winzer, including but not limited to GCash, Maya (formerly PayMaya), major Philippine banks (BPI, BDO, UnionBank, Metrobank), and cryptocurrency (USDT). Minimum and maximum deposit amounts apply and are displayed during the deposit process.

All deposits must be made from payment sources in your own name. Third-party deposits are strictly prohibited and will result in the deposit being reversed and your Account potentially being suspended or terminated. winzer reserves the right to request proof of ownership of the payment method used for deposits.

Deposits are typically processed immediately, though processing times may vary depending on the payment method used. winzer does not charge fees for deposits, though your payment provider may impose their own fees. You are responsible for any fees charged by your payment provider.

4.2 Withdrawals

You may request withdrawal of your Account balance at any time, subject to meeting any applicable wagering requirements and verification procedures. Withdrawals must be made to the same payment method used for deposits, or to an alternative method in your name if the original method is unavailable.

Minimum and maximum withdrawal amounts apply as specified in the withdrawal section of the platform. Most withdrawals to e-wallets (GCash, Maya) are processed within 5-15 minutes during business hours. Bank transfers may take 1-3 business days. Processing times may be longer during high-volume periods or if additional verification is required.

winzer reserves the right to refuse or delay withdrawals if we suspect fraud, money laundering, or other illegal activity, or if your Account is under investigation for violation of these Terms. We may require additional verification documents before processing large withdrawals or withdrawals to new payment methods.

4.3 Currency and Conversion

All transactions on the winzer platform are conducted in Philippine Pesos (PHP) unless otherwise specified. If you deposit funds in a different currency, the amount will be converted to PHP at the prevailing exchange rate at the time of the transaction. Exchange rates are determined by third-party payment processors and may include conversion fees.

5. Gaming Rules and Conduct

5.1 Game Rules

All games offered on the winzer platform are subject to specific rules, payout structures, and wagering requirements as displayed within each game. By participating in any game, you agree to be bound by the specific rules applicable to that game. Game rules take precedence over these general Terms in case of conflict regarding gameplay.

RNG systems are regularly audited by independent testing laboratories to verify fairness and randomness. Game outcomes are determined at the time of play and cannot be influenced by winzer or any third party.

5.2 Bet Limits

Minimum and maximum bet limits apply to all games and are clearly displayed within each game interface. winzer reserves the right to modify bet limits at any time without prior notice. Special bet limits may apply to certain players based on their gaming history, account status, or other factors at winzer's sole discretion.

5.3 Malfunctions

In the event of a game malfunction, system error, or technical failure, all affected bets and payouts shall be void and refunded. You agree to immediately report any suspected malfunction or error to winzer customer support. Continued play or exploitation of a known malfunction constitutes a violation of these Terms and may result in account termination and forfeiture of winnings.

winzer shall not be liable for any losses resulting from system malfunctions, network failures, or other technical issues beyond our reasonable control. In the event of a dispute regarding game outcomes, winzer's transaction logs shall be deemed conclusive evidence.

6. Bonuses and Promotions

6.1 Bonus Terms

winzer may offer various bonuses, promotions, and rewards to users from time to time. All bonuses and promotions are subject to specific terms and conditions, including wagering requirements, game restrictions, time limits, and maximum withdrawal amounts. These specific terms are provided with each bonus or promotion and form part of these Terms.

Bonuses are granted at winzer's sole discretion and may be modified, suspended, or terminated at any time without prior notice. winzer reserves the right to refuse or cancel any bonus if we suspect abuse, fraud, or violation of the bonus terms. Only one bonus may be active per Account at any given time unless otherwise specified.

6.2 Wagering Requirements

Most bonuses are subject to wagering requirements, meaning you must wager the bonus amount (and sometimes the deposit amount) a specified number of times before you can withdraw bonus winnings. Wagering requirements, eligible games, and other conditions are clearly stated in the terms of each specific bonus.

Different games contribute differently toward meeting wagering requirements. Slots typically contribute 100%, while table games and live casino games may contribute less or not at all. You agree not to engage in any of the following prohibited activities:

• Fraud and Deception: Providing false information, using stolen payment methods, creating duplicate accounts, or engaging in any form of fraudulent activity.
• Money Laundering: Using the Services to launder money or engage in any illegal financial activities. All suspicious transactions will be reported to appropriate authorities.
• Cheating and Collusion: Using software, bots, or automated systems to play games, colluding with other players, or exploiting software bugs or errors.
• Account Sharing: Allowing any other person to access or use your Account, or accessing or using another person's Account.
• Reverse Engineering: Attempting to decompile, reverse engineer, or otherwise discover the source code of any software or systems used by winzer.
• Unauthorized Access: Attempting to gain unauthorized access to any part of the Services, other users' accounts, or winzer's computer systems or networks.
• Abusive Behavior: Harassing, threatening, or abusing other users, winzer staff, or game providers through any communication channel.
• System Interference: Interfering with or disrupting the Services, servers, or networks connected to the Services, or disobeying any requirements, procedures, policies, or regulations of networks connected to the Services.

Violation of any prohibited activities will result in immediate account termination, forfeiture of all balances and winnings, and potential legal action. winzer reserves the right to report suspected illegal activity to law enforcement authorities.

8. Intellectual Property

All content on the winzer platform, including but not limited to text, graphics, logos, images, software, audio, video, and game content (collectively, "Content"), is the property of winzer or its licensors and is protected by Philippine and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content obtained from the Services without express written permission from winzer.

The winzer name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of winzer or its affiliates or licensors. You must not use such marks without the prior written permission of winzer. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

9. Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. winzer DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL winzer, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless winzer, its affiliates, and their respective directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from (i) your use of the Services; (ii) your violation of these Terms; (iii) your violation of any rights of another party; or (iv) your violation of any applicable law or regulation.

10. Account Termination

10.1 Termination by You

You may terminate your Account at any time by contacting customer support. Upon termination, you may withdraw any remaining balance in your Account subject to meeting any applicable wagering requirements and verification procedures. Once an Account is closed, it cannot be reopened.

10.2 Termination by winzer

winzer reserves the right to suspend or terminate your Account immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms or any applicable laws
• Suspected fraud, money laundering, or other illegal activity
• Failure to provide requested verification documents
• Abusive, threatening, or harassing behavior
• Creation of multiple accounts
• Bonus abuse or exploitation of system errors
• Extended period of inactivity (typically 12 months or more)

Upon termination by winzer, you may withdraw any remaining balance subject to verification and investigation. If your Account is terminated for violation of these Terms or suspected illegal activity, winzer reserves the right to forfeit any balances and winnings and report the matter to appropriate authorities.

10.3 Inactive Accounts

Accounts with no login activity for twelve (12) consecutive months may be classified as inactive. winzer reserves the right to charge an administrative fee for maintaining inactive accounts. You will be notified via email before any such fees are applied. To avoid inactivity fees, simply log in to your Account.

11. Dispute Resolution

11.1 Complaint Procedure

If you have any complaint or dispute regarding the Services, you should first contact winzer customer support at [email protected]. We will make reasonable efforts to resolve your complaint within ten (10) business days. Please provide as much detail as possible, including your Account username, transaction IDs, and a clear description of the issue.

11.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

11.3 Arbitration

For disputes that cannot be resolved through our internal complaint procedure, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The arbitration shall be conducted in English in Metro Manila, Philippines. The decision of the arbitrator shall be final and binding on both parties.

12. Changes to Terms

winzer reserves the right to modify, amend, or update these Terms at any time at our sole discretion. We will notify users of material changes by posting the updated Terms on the platform with a new "Last Updated" date and, where required by law, by sending notice to your registered email address.

Your continued use of the Services following the posting of revised Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must stop using the Services and may close your Account. It is your responsibility to review these Terms periodically for updates.

Changes to these Terms will become effective upon posting unless otherwise specified. For material changes that adversely affect your rights or obligations, we may provide advance notice and allow a reasonable period for you to review the changes before they become effective.
